FAQ for Domestic Violence Defendants

How much jail time will I receive for a domestic abuse conviction?

For a misdemeanor conviction in Washington, you may spend up to 90 days in county jail. For a gross misdemeanor, you may spend up to 364 days in county jail. If you are convicted of felony domestic abuse, you may spend up to five years or more in state prison.

In Idaho, misdemeanor penalties for domestic assault or battery apply when the victim has not sustained a traumatic injury. A first-time conviction may result in up to six months in jail and a fine of up to $1,000. An individual convicted of misdemeanor domestic assault or battery may face felony-level penalties if they have a prior conviction for felony domestic battery or violating a protection order. This can result in up to 10 years in prison and a $10,000 fine.

What penalties will I face if I violate a protective order?

In Washington State, courts may impose penalties of up to one year in jail, a fine of up to $5,000, or a combination of both for a misdemeanor violation. A felony violation can incur up to 5 years in jail and a fine of up to $10,000. 

In Idaho, violation of a protection order is considered a misdemeanor offense and may result in up to one year in jail and a fine of up to $5,000. Penalties increase with repeat offenses.

Can I expunge a domestic violence charge from my criminal record?

Yes. In Washington State it is possible to get misdemeanor domestic abuse charges expunged from your record. For this to happen, you have to fulfill the terms of your sentence and then wait for five years before seeking expungement.
